What is the first step in recovering a debt?
The first step is to send a formal “Letter Before Action” to the debtor setting out the details of the debt and how to pay it. How much does it cost to issue a County Court Claim?
This will depend on the value of the debt. In most cases we can offer a fixed fee for the work carried out (usually £180 plus VAT) however the Court fee is calculated according to the amount claimed. I have obtained a CCJ but the debtor hasn’t paid. What is the next step?
If a debtor refuses to pay after you have obtained a court judgment then you may have to commence enforcement proceedings. The most effective enforcement method will depend on several factors such as the value of the debt or the debtors circumstances. I am owed money but I don’t know where the debtor is. What can I do?
A County Court claim for debt cannot be issued without an address therefore it is imperitive to know the whereabouts of the debtor.
