Mark Aspin

Mark is a Director and is Head of Dispute Resolution. Mark specialises in Property, Commercial and Employment litigation.

He practises litigation in the County Court, High Court and specialist Tribunals; conducting his own advocacy as appropriate.

Property litigation

Mark’s regular caseload include Landlord and Tenant claims for both residential and commercial properties under the Landlord & Tenant Act 1954. He deals with rent arrears and other tenancy breaches that can lead to forfeiture action. He also works with surveyors on end of tenancy claims, including dilapidations.

Agricultural property disputes are also included including tenancy claims arising out of the Agricultural Holdings Act or Farm Business Tenancies; and notices to quit.

Mark also acts on behalf of parties seeking advice on boundary disputes and enquiries concerning rights of way; as well as nuisance and harassment.

Commercial litigation

Mark acts for commercial clients around the UK as part of the Business Services Team, especially Scottish clients seeking advice on matters within the English jurisdiction.

As well as commercial property disputes set out above, Mark deals with contractual disputes between companies (including contested debt recovery). He also has a niche interest in defamation law and insolvency advice.

Employment

As part of the employment team Mark acts for both employers and employees, ensuring a broad foundation of knowledge to assist all clients. He particularly deals with employment issues that are litigated in the County Court and proceedings in the Employment Tribunal.

ABOUT MARK

Mark graduated from the University of Essex in 2007 with a degree in English & European Laws, also obtaining a diploma from Université Paris X (Nanterre) as part of his undergraduate studies. He has subsequently also obtained a Masters degree in Advanced Legal Practice from the University of Central Lancashire (2015).

He completed his training contract at Cartmell Shepherd and on qualification in 2010 joined the Dispute Resolution team. He was made an associate in 2015 and became a director in 2017.

Away from work, Mark is a senior volunteer with the St John Ambulance and chairman of the “Abbey Singers” choir in Carlisle.

MARK’S APPROACH

Mark is a committed litigator who involves himself fully in cases so that, where appropriate, he will handle trial advocacy himself in the full knowledge of the case.

His advice has been described as “straight forward” and he always tries to avoid “legalese”.

Whilst Mark is ready and willing to take matters to trial, he recognises the benefits of early settlement and is a strong supporter of Alternative Dispute Resolution. He agrees with many clients that the only winner following a trial is very often the lawyers, and will encourage clients to engage in settlement discussions at the earliest appropriate time in an attempt to resolve matters amicably.
